What this is

What the platform does
It gives a merchant a shop that runs inside Telegram: a catalog, a cart, orders, and notifications to both sides. The merchant brings their own bot, keeps their own buyers, and sells under their own name.
What the platform is not
It is not a marketplace and takes no share of what is sold. It is not a party to the sale: the contract is between the merchant and their buyer, and so is everything that follows from it — the goods, the delivery, the money, the refund, and the answer when something goes wrong.
If somebody brings a claim against the platform over what a merchant sold, said or did, the merchant settles it and makes good what the platform bore because of it.
What a merchant is responsible for
What they sell, what they say about it, and doing what they promised a buyer. Their own bot token and the account behind it. Following the law that applies to them, including whatever they owe their buyers about their own data.
Your buyers' data
What is done with your buyers' data is yours to decide. The platform keeps it for your shop so that the shop works: takes orders, shows them to you, carries the conversation and tells both sides. What is kept about a buyer is set out in the privacy policy; it is kept as long as the shop exists.
The platform acts only on your instructions — your shop's settings and what you ask of it — and does nothing else with that data. The people who maintain the platform can reach it, and they are bound to keep it confidential. Each shop sees only its own orders, the bot token is stored encrypted, and backups are taken continuously.
By accepting these terms you agree to the services the privacy policy lists. The platform tells you of a change to that list through its bot before the change takes effect, and you may object; if the objection cannot be met, you may close your shop. Each such service is bound to keep the data as the platform is.
When a buyer asks to see, correct or remove their data, the platform helps you do it, and it helps you meet your other duties about that data. If the platform becomes aware of a breach of buyers' data security, it tells you without undue delay. When you close your shop and ask for it to be removed, your buyers' data is removed with it; before that you may ask for a copy. On request, the platform shows you how it keeps these terms.
What is not allowed here
Selling what the law forbids. Using a shop to deceive somebody. Pretending to be a person or a business you are not. Anything that puts the platform or another merchant's shop at risk.
Anybody who finds a shop doing one of these — a buyer, another merchant, anyone at all — can write to support@instatg.com and name the shop. Every such message is read and answered.
A shop that does one of these stops serving, and its merchant is told why. Where it can wait, a warning comes first. A merchant whose shop was stopped can answer at support@instatg.com; if the answer shows they did none of the above, the shop serves again.
Price
What these terms describe is the free plan, and it is free for every shop, opened before this text or after it.
A paid plan adds to the free one. What it adds, what it costs and for how long are shown in the shop's settings before the merchant pays. Nothing puts a shop on a paid plan it pays for except a payment its merchant made — through the platform's bot, or otherwise and recorded by the platform: not silence, not being told, and not how many products or orders it has. The platform may also give a shop a paid plan for nothing.
When a paid period ends without a new payment, the shop is back on the free plan, and nothing in it is deleted.
Taking something out of the free plan is a change to these terms, and any merchant already selling is told of it before it takes effect.
Banks, carriers and other services a merchant connects charge on their own terms.
Nothing is promised about uptime
The platform is offered as it is. It is watched, it is backed up, and it is repaired when it breaks — but nobody here promises it will never break, and no compensation follows from it having broken. This does not cover harm the platform does on purpose.
Ending it
A merchant may close their shop whenever they like and ask for it to be removed. The platform may stop serving a shop that breaks the rules above, and will say which one.
If the platform stops serving every shop, merchants are told through its bot at least thirty days ahead, and until then each may ask for a copy of their shop's data.
When this text changes
A change takes effect on the date it names, and is published at least five days before it, so a merchant who does not accept it can close their shop while the text they accepted still governs. The text it replaced stays readable at an address of its own, so a merchant can always read the one they accepted.
Law and courts
These terms are under the law of Ukraine, and a dispute about them goes to a court of Ukraine.
